This statement summarises the way in which personal information is held and processed by Care Inc Ltd, the trading name of which is Peter Cheer Consulting.
The purposes for which personal information is held and processed
Care Inc Ltd holds and processes personal information for a number of purposes:
1. For the operation of the company, including marketing purposes, the employment of staff and the engagement of associates. Data for marketing purposes is held with the consent of the subject. Data for the employment of staff and the engagement of associates is held as a requirement of relevant contracts and to comply with relevant statutes. Data may also be held and processed where it is in the legitimate interests of the company to do so.
2. To fulfil contracts with customers of the company. Some of this data will be held with the consent of the subject, some as a requirement of the contract and some to fulfil the legitimate interests of the company.
Personal information held under point (2) won’t be used for marketing purposes. The exception would be if a contact was made in the course of fulfilling a contract which led to agreement to keep in touch separately; with the agreement being, for example, in the form of an exchange of business cards, the acceptance of an invitation to connect by social media, or an email exchange which could reasonably be interpreted as indicating an agreement to keep in touch.
Data Controller
Where data is held for the operation of the company, the Data Controller is Care Inc Ltd., a company registered in England and Wales with company number 09603789.
Where data is held in order to fulfil a contract with a customer of the company, the Data Controller will usually be that customer. This means that Care Inc Ltd will usually be a data processor. However, there may be some exceptions to this.

Disclosure of information to third parties
Care Inc Ltd’s policy is not to disclose personal information to a third party except with the consent of the subject or as follows:
1. In order to comply with the law; for example in relation to staff payroll information, where information has to be shared with HMRC.
2. Unless there is an exceptional reason not to do so, data held for the purpose of fulfilling a contract with a customer may be disclosed to that customer.
3. If Care Inc Ltd’s contract with a customer allows Care Inc Ltd to sub-contract some or all of the work to be undertaken, personal data held for the purposes of fulfilling that contract may be disclosed to any sub-contractor used or considered.
4. It is possible that a situation could arise in which Care Inc Ltd needed to disclose information to a third party in order to comply with the law or with accepted professional standards. An example could be if Care Inc Ltd became aware of a safeguarding situation in a care service or had concerns about care quality. In such situations, information might be disclosed to an appropriate statutory body.
5. There may also be the need for Care Inc Ltd to share personal information with its professional advisors or with other organisations providing support services to Care Inc Ltd.
Where personal information is shared with a third party, Care Inc Ltd will seek reasonable assurances that it will be held securely and processed appropriately by that third party.
Security
Care Inc Ltd works hard to ensure the security of all of the personal information it holds. Paper records are kept in locked filing cabinets and the transportation of paper records is minimised. Laptops and any portable media are fully encrypted. Passwords are used when sensitive data is sent by email. Employees are briefed on data protection and their contracts of employment require them to maintain the confidentiality of company information. Guidelines on data and cyber security are provided to any employees or associates.
Data retention
Personal information will only be retained for as long as is needed for the purpose for which it was obtained, or longer if required by law.
The length of time for which information obtained under a contract with a customer of Care Inc Ltd is retained will, when specified in that contract, be as required by that contract.
Information held for marketing and other company purposes will be retained for as long as it is judged reasonable and relevant to be held, unless the subject requests at an earlier date that it should no longer be retained.

3. Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances.
4. Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances.
5. Your right to object to processing - You have the right to object to the processing of your personal information in certain circumstances.
6. Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.
7. You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
